The most powerful tool employers can rely on when it comes to unlawful disclosure or use of secret information by employees is trade secret protection. Although in the Italian legal system technical and commercial information are also protected under criminal law, the author dislikes the idea of people going to jail, and this chapter is rather focused on civil remedies. Whether trade secrets can be considered an (intellectual) property right is debated.
