The system of patent rights was established fundamentally to encourage inventors to create new inventions in exchange for an exclusive right for a specific time period. A patent confers to the owner the right to exclude others from making, using, offering for sale, and selling the invention within the territory where the patent is granted. The patent eligibility requirements are novelty, non-obviousness (in some statutes or conventions called inventive step), and usefulness (also referred to as utility or capability of industrial application).
