At the end of the eighties and the beginning of the nineties of the last century Dutch courts made a name for themselves. The Netherlands was known as a country where the courts had strong judges which afforded the patentee a reasonable scope of protection and where using the famous Kort Geding the patentee could obtain cross border injunctions in a short time for a reasonable price. In short: a paradise for the patentee with a functioning European patent system. Although the “victims” of this system (the infringers who did not have the benefit of drawn out proceedings in each European country) sometimes qualified it as “cowboy justice”, the neutral patent scholar will find remarkably few bad decisions.
