An Internet service providers’ (hereinafter ‘ISPs’) liability involves principles and values and provides for a playground in which traditional principles have to deal with both technical and ideological matters of paramount importance. ISPs are subjects that offer a number of different services on the web. Until now, the web was meant to be a free and neutral network linking people and information all around the world. The services provided by ISPs make such global connection possible and worth being established. Accordingly, the way in which ISPs’ liability is set out concerns such fundamental rights as freedom of expression, creativity, privacy, right to oblivion and intellectual property.
