Although trade secrets have been one of the four main areas of intellectual property law, it has not received wide academic, policy or media attention. The lack of attention in this area has led Sharon Sandeen to lament how the subject has been relegated to the “Cinderella of intellectual property law”.1 In recent years, however, trade secrets have received greater attention in the intellectual property debate – both domestic and international. Going hand in hand with this development is the greater attention paid to restrictive covenants, which not only involve trade secrets or other conidential information, but also touch on unfair competition, labour and competition laws.
