Australia’s Tobacco Plain Packaging legislation was also challenged under the WTO Dispute Settlement System. Five WTO Members brought disputes against Australia’s measures alleging inconsistency with the WTO TBT and TRIPS Agreements. This chapter summarises selected IP-related findings from the Panel report circulated in June 2018, some of which have been appealed and are pending before the WTO Appellate Body.
