This chapter deals with the vexed question of reconditioned or spare parts and trademark law in Hong Kong and China. The question seems vexed in most jurisdictions and extends to other intellectual property (IP) causes of action as we will see in the other chapters of this book. IP protection for spare parts across the various IP causes of action is often cumulative, that is, one must address the trademark, patent, copyright, and other cause of action issues in relation to the same spare part.
